The Court of Appeal found that the appellant's retirement was premature and therefore wrongful and unfair, as the only reliable documentary evidence of her date of birth was her national ID card indicating 1954 as her year of birth. Accordingly, she should have retired in 2009 or thereabouts, not 2007. However, the court held that reinstatement was neither appropriate nor practicable given the appellant's age at the time of the appeal. The court further found that the compensation awarded by the trial court—six months' salary in lieu of notice and the equivalent of six months' wages as damages for unlawful retirement—was adequate.
