Ratio Decidendi

The court found that Jemimah Wanjiru Kibicho had not been lawfully appointed as guardian ad litem or next friend for Kibicho Migwi Kibicho by the High Court as required under the Mental Health Act. No order of appointment was produced, and self-appointment is legally ineffective. As such, she lacked the legal capacity to institute the suit on behalf of her husband. The absence of such capacity rendered the entire suit a nullity ab initio. Consequently, the court lacked jurisdiction to consider the substantive issues regarding the alleged fraudulent transfer or the validity of the land titles. The suit was therefore struck out for incompetence and abuse of court process.
