Procedural Posture

Tribunal Claim / Judgment

  1. 1 Whether the Claimant is entitled to a refund of his savings from the Respondent Sacco.
  2. 2 Whether the Claimant is entitled to dividends and damages as claimed.

Ratio Decidendi

The Tribunal found that the Claimant was a member of the Respondent Sacco, had made total payments of Kshs. 105,000, and had already received a partial refund of Kshs. 30,000. The Tribunal accepted the Respondent's position that Kshs. 1,000 constituted non-refundable share capital, leaving a balance of Kshs. 74,000 as the refundable amount. The Claimant failed to provide evidence to support his claims for dividends and damages, and these claims were therefore dismissed. The Tribunal held that the Claimant had sufficiently proved his entitlement to a refund of Kshs. 74,000, together with costs and interest from the date of filing at Tribunal rates until payment in full.

Court Disposition

Orders

  • Immediate refund of Kshs. 74,000 to the Claimant.
