Ratio Decidendi

The High Court found that the trial magistrate erred in apportioning 100% liability to the appellant in the absence of clear evidence as to fault, and that, following established legal principles, liability should have been apportioned equally between the parties. The court also found that the award of Kshs. 500,000 in general damages was inordinately high compared to comparable cases with similar injuries and reduced it to Kshs. 250,000. Special damages as awarded by the trial court were upheld. Each party was ordered to bear its own costs of the appeal, as the respondent only partly succeeded.
