Ratio Decidendi

The Court held that the respondents failed to institute an appeal within the 60-day period prescribed by Rule 84(1) of the Court of Appeal Rules, and did not serve a letter bespeaking proceedings to benefit from any extension of time. In the absence of any response from the respondents and in light of the clear provisions of Rules 84 and 85, the notice of appeal lodged on 5th December 2019 must be deemed withdrawn. The applicant is entitled to costs as the party in default is liable for costs when a notice of appeal is deemed withdrawn. The application was therefore allowed, and the notice of appeal was deemed withdrawn with costs to the applicant.
