The supporting affidavit did not explain why the applicant did not respond to the claim in CTC.NO. E350 of 2024 or take action upon service in June 2024, instead waiting two months before seeking leave to appeal. The Tribunal also noted that the draft Memorandum of Appeal raised issues of process that would more appropriately be addressed by the High Court through judicial review, not the Tribunal. As such, the application for leave to appeal out of time and for stay of proceedings was dismissed, despite being unopposed.
