Upon re-evaluation of the evidence, the court determined that the respondents were largely to blame for the accident, as the driver of the motor vehicle was speeding and on the wrong lane, while the deceased also contributed to the accident. The police evidence was found to be unreliable and skewed towards the defence, particularly due to the lack of credible eyewitnesses and inconsistencies in the respondents' testimony.
