The evidence did not support that the tenant was aware of the notice prior to 19/10/2022, and the supporting documents from the landlady did not validate proper service. The tribunal further held that while there were rent arrears, the right to levy distress for rent does not require leave of the tribunal, but the tenant was granted 30 days to settle the arrears (Kshs. 140,000) before the landlady could exercise this right.
