Procedural Posture

Miscellaneous Civil Application / Ruling on Notice of Motion Seeking Leave to Determine Issue of Retainer

  1. 1 Whether the Notice of Motion dated 19th September 2024 is res judicata.
  2. 2 Whether leave should be granted to determine the issue of retainer.

Ratio Decidendi

The court found that although there have been several applications and preliminary objections in the matter, the issue of retainer has never been expressly deliberated on or conclusively determined. The Notice of Motion dated 19th September 2024, which seeks leave to have the issue of retainer determined, is therefore not res judicata. The application is merited, and leave is granted to the respondent to have the issue of retainer fully deliberated and resolved by the court. Costs are to be in the cause, and the matter is set for hearing on 3rd February 2025.

Court Disposition

Application allowed; leave granted to determine issue of retainer.

Orders

  • Leave is granted to the respondent to have the issue of retainer fully deliberated and resolved by the court.
  • Costs to be in the cause.
