The High Court found that the appellant, having pleaded guilty, could only appeal on the legality of the sentence. The trial court imposed a sentence of a fine of Ksh. 250,000 or, in default, 2.5 years imprisonment, which exceeded the statutory maximum of 12 months imprisonment in default of a fine above Ksh. 50,000 as per Section 28(2) of the Penal Code. The trial magistrate also failed to consider the appellant's early plea of guilt as a mitigating factor. There was no evidence of refund of the stolen money at the time of sentencing.
