Ratio Decidendi

The court found that although the delay from the issuance of the certificate of costs on 13/10/2020 to the filing of the application on 27/6/2022 was manifestly inordinate, the applicants satisfactorily explained the delay as being due to lack of notice of the ruling delivered on 24/1/2022. The court accepted that the applicants only became aware of the ruling belatedly and that the delay was not deliberate or in bad faith. Applying the principles governing extension of time, the court exercised its discretion to grant leave to the applicants to file their reference out of time, subject to the applicants paying the costs of the application to the respondents.
