Ratio Decidendi

The court found that the plaintiffs' application was premised on a mistaken belief that the caution registered as entry number 6 on Karai/Karai/579 still subsisted and that the property remained registered in the name of the deceased. However, the land register and a prior judgment (Thika ELC Case No. 689 of 2017) demonstrated that the caution had already been revoked and the title closed on revision by court order. As such, the questions posed in the Originating Summons were moot and incapable of attracting any legal remedy. The suit was therefore struck out as it was brought under a misapprehension of the factual and legal position.
