Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to an order for stay of execution of the judgment pending appeal.
  2. 2 Whether the application was brought without unreasonable delay.
  3. 3 Whether the applicant has demonstrated substantial loss if stay is not granted.

Ratio Decidendi

The court found that the application for stay of execution was brought without delay, as the applicant sought leave to appeal out of time and promptly filed the application. The applicant demonstrated that demolition of the building on the suit land, where he has operated his business since 1969, would result in substantial loss. The court held that security for due performance is at the court's discretion and ordered the applicant to deposit Kshs 100,000 as security. Consequently, the court granted a stay of execution pending the hearing and determination of the appeal, subject to the applicant providing the ordered security within 30 days. No order was made as to costs.
