The court held that while the applicant's health condition and compliance with previous bail terms do not, in themselves, constitute exceptional or unusual circumstances warranting bail pending appeal, the most critical consideration is whether the appeal has overwhelming chances of success. Upon reviewing the trial court's judgment and proceedings, the court found that the applicant's appeal is arguable with a likelihood of success. Consequently, the court exercised its discretion to grant bail pending appeal, subject to the applicant posting a bond of Kshs. 200,000 with a surety of a similar amount, and directed that the appeal be filed within 45 days.
