The court found that Martha Pius Kinyamasyo lacked the legal capacity to lease the premises to the appellant at the material time, as she had not obtained a grant of representation and the property had already been allocated to the respondents' family following a family meeting. The purported lease was therefore unenforceable. The respondents, having been allocated the premises and having notified the appellant, were entitled to demand rent and levy distress. The appellant failed to prove his claim for special damages, as the evidence was contradictory and unsupported by documentary proof.
