The court found that the appellant had demonstrated the likelihood of suffering substantial loss if evicted from the suit property, which currently houses a school, and that such loss could render the appeal nugatory. The application for stay was filed without unreasonable delay, and the court was satisfied that the circumstances did not require provision of security for due performance, as the suit land would remain available after the appeal. The court exercised its discretion in favour of granting a stay of execution pending the determination of the appeal, in line with the principles set out in Order 42 Rule 6 of the Civil Procedure Rules and relevant case law.
