The Tribunal found that the notice of termination dated 26th January 2023 was lawful as the tenant was in rent arrears equivalent to three months at the time of notice, which entitled the landlord to terminate the tenancy under Section 7(1)(b) of the Act. The tenant had also breached covenants in the lease agreement by failing to pay electricity bills and his share of the liquor license fee. The landlord's claim for termination on grounds of personal use failed due to lack of evidence of intention or capacity to use the premises for his own business.
