The only lawful forum for distribution of the suit properties was the succession proceedings, which had already been concluded with a confirmed grant and judgment. Maintaining the present suit or the cautions/restrictions was no longer tenable, as the transfer of ownership could only occur through transmission as per the succession court's orders.
