Procedural Posture
Criminal Revision / Ruling on Procedural Directions
Legal Issues
- 1 Whether the court had issued an order for a Probation report as claimed by the applicant's counsel.
- 2 Which of the two related criminal revision files should be treated as the lead file.
- 3 What procedural directions should be given regarding the hearing of the related files.
Ratio Decidendi
The court found that no order for a Probation report had been issued previously, contrary to the applicant's counsel's assertion. Upon reviewing the record, the court determined that the related criminal revision files should be managed together, with Nairobi High Court Criminal Revision No E547 of 2023 designated as the lead file. The court directed that both files be placed before Hon. Lady Justice Mutende for further directions, and a production order was issued for the applicant. These directions were necessary to ensure procedural clarity and efficient case management.
Court Disposition
Procedural directions issued; no substantive determination on merits.
Orders
- Both Criminal Revision files E547 of 2023 and E568 of 2023 to be placed before Hon. Lady Justice Mutende on September 27, 2023 at 2:30 pm for directions.
- Production order to issue for the applicant.

Ruling
1. I have perused the order of this court made on August 28, 2023 and note that the file is still active. However, I did not issue orders for a Probation report to be availed as indicated by counsel for the applicant.
2. From the record, Nairobi High Court Criminal revision No E547 of 2023 was filed on July 25, 2023 and Revision Case No E568 of 2023 was filed on August 1, 2023. It is my view that the lead file should be Nairobi High Court Criminal Revision No E547 of 2023.
3. I therefore direct that the two files be placed before Hon. Lady Justice Mutende on September 27, 2023 at 2:30 pm for directions.
4. Production Order to issue for the Applicant.
