Ratio Decidendi

The court found that the applicants had provided a reasonable explanation for the delay in filing the appeal, namely the inability of their advocates to contact them due to technological changes. The court determined that the delay was not inordinate, was not intended to prejudice the respondents, and that the applicants had an arguable appeal. Applying the principles from Section 79G of the Civil Procedure Act and relevant case law, the court exercised its discretion to grant the extension of time, on condition that the appeal be filed and served within 30 days. No order as to costs was made.
