The Plaintiffs failed to satisfy all the conditions for grant of a stay of execution pending appeal as required by Order 42 Rule 6(2) of the Civil Procedure Rules. The court found that the Plaintiffs were not in possession or occupation of the suit property at the time of judgment or at the time of the application, as confirmed by the County Surveyor's and Deputy Registrar's reports. Therefore, the Plaintiffs could not demonstrate that they would suffer substantial loss if the order for stay was not granted.
