However, due to lack of documentary proof of the deceased's income and dependency, the court applied the global sum method, awarding Ksh.800,000 for loss of dependency. For pain and suffering, the court awarded Ksh.150,000, and for loss of expectation of life, Ksh.200,000, but held that the Law Reform Act awards were subsumed in the Fatal Accidents Act award, thus only Ksh.800,000 was payable as general damages.
