Procedural Posture

Civil Appeal / Ruling on Application for Review of Previous Orders

  1. 1 Whether the court should review its previous order regarding the release of a specific motor vehicle.
  2. 2 Whether the order directing the 1st respondent to tax his charges should be set aside and substituted with an order for the 2nd respondent to tax its charges and storage charges.

Ratio Decidendi

The court found that there was a clear error in the identification of the motor vehicle to be released in its previous order, as the registration number was incorrectly stated. Additionally, the court determined that the order for taxation of charges was directed to the wrong party. In the interests of justice and to give effect to the true intention of the court, the orders were reviewed and corrected to reflect the proper motor vehicle and the correct party for taxation of charges. The court exercised its discretion under Order 45 of the Civil Procedure Rules to review and amend its previous orders accordingly.
