Procedural Posture

Tribunal Reference / Ruling on Jurisdiction and Preliminary Application

  1. 1 Whether the Tribunal has jurisdiction to preside over the dispute herein.
  2. 2 Whether the Tribunal may grant the prayers in the notice of motion dated 6.4.2023.

Ratio Decidendi

The Tribunal determined that it lacked jurisdiction to hear and determine the dispute because the Applicants were not seeking reliefs as tenants under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, Cap 301. The evidence showed that the Applicants had vacated the premises, the landlord/tenant relationship had ceased, and the Applicants' claims did not arise from a controlled tenancy. The Tribunal's jurisdiction is strictly limited to disputes arising from such relationships. As such, the prayers sought in the reference and notice of motion could not be entertained, and the matter was dismissed for want of jurisdiction.

Court Disposition

Reference and notice of motion dismissed for want of jurisdiction.

Orders

  • The Reference and the notice of motion dated 6.4.2023 are hereby dismissed in their entirety for want of jurisdiction.
  • Each party shall bear its own costs of the Reference and the application.
