Ratio Decidendi

The court found that the petitioner was entitled to have the period spent in remand custody deducted from his sentence pursuant to section 333(2) of the Criminal Procedure Code. The trial court did not indicate that it had considered the 14 months the petitioner spent in custody prior to sentencing. The appellate court had already substituted the death sentence with a 10-year term for each count, to run concurrently. The court held that the sentence should be computed from the date of arrest, 05/02/2017, and not from the date of sentencing, 17/05/2018. This ensures compliance with statutory and policy requirements and prevents excessive punishment.
