The trial court erred by convicting and sentencing the appellant on the alternative count after entering a plea of not guilty on the main count, without proceeding to hear and determine the main count. This procedural irregularity rendered the entire trial a nullity or mistrial, as an admission of an alternative count cannot dispose of the main count. The proper procedure required the trial court to conduct a full hearing on the main count after the plea of not guilty. The miscarriage of justice occasioned by this error necessitated quashing the conviction and setting aside the sentence.
