The Court of Appeal lacks jurisdiction to entertain an application for extension of time to appeal in a succession matter where the applicant has not sought or obtained leave to appeal from the High Court. The law and consistent judicial authority require that leave is a mandatory prerequisite for an appeal to the Court of Appeal in succession matters. The applicant's failure to obtain such leave is fatal to the application, and the preliminary objection on jurisdiction is meritorious. Consequently, the application for extension of time is struck out for want of jurisdiction.
