The court found that the applicant failed to demonstrate any substantial loss that would be suffered if stay was not granted, did not show any threat of execution or prejudice, and did not offer any security for the due performance of the decree. The application was not supported by evidence of the applicant's residence on the suit property or any imminent execution. The court held that the principles for grant of stay of execution pending appeal, as set out in Order 42 Rule 6 of the Civil Procedure Rules and relevant case law, were not satisfied. Consequently, the application for stay of execution pending appeal was dismissed with costs to the respondent.
