Ratio Decidendi

The Court found that the Respondent complied with the requirements of procedural fairness by issuing a notice to show cause, conducting a disciplinary hearing, and providing an opportunity to appeal. The Claimant's refusal to comply with lawful instructions from his superiors, as evidenced by email correspondence, constituted a valid and fair reason for termination. The Respondent, however, failed to prove the counterclaim for outstanding loans, as no contractual records were produced to substantiate the alleged debt. Consequently, both the main claim and the counterclaim were dismissed for lack of merit.

Court Disposition

Both the Cause and Counterclaim are dismissed for lack of merit.
