The trial court erred in assessing quantum based on unproven injuries, resulting in an excessive award for general damages. The High Court set aside the award of Kshs. 250,000 and substituted it with Kshs. 80,000 for pain and suffering, upholding the special damages of Kshs. 6,120. Liability remained at 100% against the appellants. Each party was ordered to bear its own costs of the appeal.
