Criminal Petition / Ruling on Resentencing Application After Dismissal of Appeal

  1. 1 Whether the High Court has jurisdiction to resentence the petitioner after having already dismissed his appeal against conviction and sentence.
  2. 2 Whether the doctrine of functus officio precludes the High Court from reviewing its own decision on sentence.

Ratio Decidendi

The High Court, having already determined the petitioner's appeal against both conviction and sentence, is functus officio and lacks jurisdiction to entertain a subsequent application for resentencing on the same matter. The proper recourse for the petitioner, if aggrieved by the sentence, is to appeal to the Court of Appeal. The doctrine of functus officio precludes the High Court from reviewing or altering its own decision once it has been pronounced and finalized. Accordingly, the application for resentencing is dismissed for want of jurisdiction.
