The Tribunal found that the Tenant failed to demonstrate sufficient cause to set aside the ex parte orders of 29th February, 2024. The Tribunal was satisfied that there was an affidavit of service indicating the Tenant was served with the application and hearing notice. The Tenant's evidence of rent payment was inconsistent and did not cover the period in question, with the last payment made on 5th February, 2024. The Tribunal observed that the Tenant had not paid rent from January to date, had closed the shop, and had not given the Landlord access. The Tribunal concluded that the Tenant's conduct did not warrant the exercise of discretion to set aside the orders, and therefore dismissed...
