Procedural Posture
Criminal Revision / Ruling on Application for Sentence Review
Legal Issues
- 1 Whether the applicant's sentence should be reviewed on account of his deteriorating medical condition.
- 2 Whether the period already served in custody is sufficient in the circumstances.
Ratio Decidendi
The court found that the applicant's medical condition—specifically, the need for urgent chemotherapy for anal carcinoma and his extremely emaciated state—constituted exceptional circumstances justifying a review of his custodial sentence. The court noted that the applicant had already served a significant period in custody since August 2021 and that continued incarceration would be detrimental to his health and impede access to necessary medical treatment. The prosecution did not oppose the application. Accordingly, the court exercised its discretion to reduce the sentence to the period already served, ordering the applicant's immediate release unless otherwise lawfully held.
Court Disposition
Sentence reduced to period already served; applicant to be released forthwith unless otherwise lawfully held.
Orders
- The sentence of ten years imprisonment is reduced to the period already served.
- The applicant shall be released from custody forthwith unless lawfully held for any other reason.
