The court found that the respondent, who alleged fraud in the subdivision and transfer of the suit property, failed to prove fraud to the required legal standard. The evidence showed that the application for consent of the Land Control Board, the consent itself, and the transfer form were all executed during the lifetime of Mufutu, the original proprietor. There was no evidence that these documents were forgeries or that the appellant was party to any fraud. The mere fact that registration of the transfer occurred after Mufutu's death did not, in law, invalidate the transaction, as a transfer can be perfected posthumously if the transaction was completed inter vivos.
