Procedural Posture

Tribunal Claim / Judgment

  1. 1 Whether the claimant is entitled to a refund of his deposits if the loan he took remains unsatisfied.

Ratio Decidendi

The Tribunal found that the claimant had not fully settled his loan, and even if his deposits were applied to the outstanding amount, a balance would remain. The contractual terms binding the claimant required full repayment of the loan before resignation could be effected. The Tribunal held that the claimant was not entitled to a refund of his deposits until the loan was fully satisfied, and the claim was therefore without merit.
