The relevant provisions of the Civil Procedure Rules (Order 1 Rule 10(2) and (4)) prohibit the introduction of a new defendant without the court's permission. Since the Plaintiff failed to comply with this mandatory requirement, the suit as against the 2nd Defendant and the related amended pleadings were bad in law and could not stand. Consequently, the court allowed the 2nd Defendant's preliminary objection and struck out the suit against the 2nd Defendant with costs.
