Ratio Decidendi

The Tribunal found that the Respondent failed to provide sufficient evidence to prove that the Claimant was involved in the alleged misappropriation of funds or that he owed any outstanding loan. The inspection report and witness testimony did not implicate the Claimant, and there was no Inquiry Report or Surcharge Order against him. The Respondent did not discharge the burden of proof required to offset the Claimant's refund. Consequently, the Claimant is entitled to the refund of Kshs 86,500, plus costs and interest, as there was no lawful basis to withhold his funds.
