The court found that although the charge was read in a language the appellant understood, the trial court failed to warn the appellant of the seriousness and consequences of pleading guilty to arson, an offence carrying a mandatory life sentence. The absence of such a warning rendered the plea equivocal. Furthermore, the trial court did not provide reasons for imposing the maximum sentence on a first offender where the value of the property was low. These procedural lapses violated the appellant's rights and undermined the validity of the conviction and sentence. Given the time already served and the interests of justice, a retrial was not ordered.
