Ratio Decidendi

The High Court found that the memorandum of appeal raised issues that required evaluation of evidence and interrogation of facts, rather than pure points of law. Section 38 of the Small Claims Court Act restricts appeals from the Small Claims Court to the High Court to matters of law only. Since the grounds of appeal did not raise any matters of law, the court lacked jurisdiction to entertain the appeal. The preliminary objection was therefore meritorious and the appeal was struck out as incompetent.
