Ratio Decidendi

The High Court lacks jurisdiction to revise a sentence that has already been affirmed by a court of concurrent jurisdiction. The revisionary powers of the High Court under Sections 362 and 364 of the Criminal Procedure Code are limited to proceedings from subordinate courts and do not extend to reviewing its own decisions or those of courts of equal status. Once the High Court has pronounced itself on an appeal, it becomes functus officio and cannot revisit the sentence. The only recourse available to the applicants is to approach the Court of Appeal, which has jurisdiction to hear appeals from the High Court. The application for revision is therefore without merit and must be dismissed.
