Miscellaneous Criminal Application / Sentence Review Ruling

  1. 1 Whether the High Court has jurisdiction to review a sentence already considered on appeal by a judge of concurrent jurisdiction.
  2. 2 Whether the applicant can seek sentence review after an appeal has been determined.
  3. 3 Whether the principle of functus officio applies to the High Court in this context.

Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence that has already been considered and determined on appeal by a judge of concurrent jurisdiction. The principle of functus officio applies, meaning the court has exhausted its mandate over the matter and cannot revisit its own or a peer court's decision. The applicant's recourse, if dissatisfied with the appellate decision, lies with the Court of Appeal and not by way of revision before the High Court. The application for sentence review is therefore without merit and must be dismissed for want of jurisdiction.
