The court found that, despite the lack of opposition from the Plaintiff/Respondent, the grounds advanced in support of the Chamber Summons and the supporting affidavit did not justify the striking out of the plaint. The court was not satisfied that the plaint was so hopeless or unarguable as to warrant summary dismissal at this interlocutory stage. The existence of contested triable issues meant that the matter should proceed to full hearing, as justice would not be served by granting the orders sought. The application was therefore dismissed, with no order as to costs.
