The delay was primarily due to the court's processes rather than the appellant's inaction. The application for dismissal was therefore premature, as the procedural requirements under Order 42 Rules 13 and 35 had not been satisfied. The court held that excusable mistakes had occurred and that the appellant appeared keen to proceed. Consequently, the application to dismiss the appeal for want of prosecution was dismissed. However, the applicant was awarded costs of Kshs. 10,000 for the inconvenience caused by the application.
