Ratio Decidendi

The court found that the applicant's bill of costs had been taxed and a certificate of taxation issued for Kshs.310,300.40, with no application to set aside or alter the certificate. In accordance with Section 51(2) of the Advocates Act and established case law, the certificate is final as to the amount of costs, and the court is obligated to enter judgment for the certified sum. Regarding interest, the court held that under Paragraph 7 of the Advocates (Remuneration) Order, interest at 14% per annum is to be calculated from thirty days after service of the bill of costs, which in this case is from 4th January, 2021. The applicant was also awarded costs of the application.
