By Notice of Motion dated 16/7/2025, the Applicant/Advocates pray for these orders; **Spent.** **THAT the Honourable court be pleased to consolidate the instant matter with;** * **NAKURU Misc Application No E295 OF 2024.** **THAT pursuant to prayer 2 above the Honourable court be pleased to enter judgment/decree for Kshs. 546,150.00 tabulated as hereunder;** * + **Nakuru Misc Application No E294 OF 2024 – Kshs. 273,075.00** + **Nakuru Misc Application No E295 OF 2024 – Kshs. 273,075.00** **Total = Kshs 546,150.00** **THAT interest be provided for at 14% per annum from 5/10/2022 until payment in full.** **THAT the cost of the Application be provided for.** 1. Despite evidence of service of the application, no reply is filed. I have studied the Applicant's affidavit in support of the Motion. The Applicant seeks consolidation of this file with E295/2024 as they relate to legal fees owing from the same Respondent. They also pray for judgment and decree in the sum of Kshs. 273,075/= in each of the two files plus interest at 14% per annum from 5/10/2022 until payment in full. 2. The application follows the Taxing Officer’s Certificate of Taxation of costs dated 1/7/2025 relating to the Applicant’s Advocate/Client Bill of Costs dated 11/9/2025. The Bill was taxed in the sum of Kshs. 273,075/= in each of the files sought to be consolidated. 3. Despite evidence of service of the application upon the Respondent, no reply has been made. The application is therefore deemed as unopposed. Indeed, the application may not possibly be opposed seeking, as it does, to enforce a lawful order of the Taxing Officer taxing the Bill of Costs dated 11/9/2025. 4. The Application is allowed with no order as to costs. This ruling applies to Miscellaneous Civil Application No. E295 of 2024 as well. **J. M.
