The High Court found that the trial magistrate's award of Kshs 400,000/- as general damages for soft tissue injuries was inordinately high and not supported by comparable judicial awards. The court noted that both medical reports confirmed the respondent sustained soft tissue injuries that had healed well, and there was no evidence of more severe or lasting harm. The court also observed that the parties had consented to adopt the liability finding in a related case, which had been revised on appeal to a 50:50 apportionment. Accordingly, the court substituted the general damages award with Kshs 140,000/-, to be apportioned equally between the parties, and upheld the special damages award....
