The court also noted that the consent order could not have been properly recorded in the absence of the applicant. Orders

  • The grant issued in Principal Magistrate’s Court Nyeri Succession Cause No. 10 of 1986 and the confirmed grant in the same cause both dated 20th September 1994 are hereby revoked and set aside.
  • The land registrar is ordered to cancel the title issued to Nelson Ngirigacha Kimanga in title Mutira/Kaguyu/2000 and the title shall revert to the deceased's name, Nduigu Wamai. The land registrar shall not require production of the title in the name of Nelson Ngirigacha Kimanga for cancellation.
