Ratio Decidendi

The court found that the applicant's bill of costs had been taxed and a Certificate of Taxation issued for Kshs.63,650.00. There was no evidence that the respondent had challenged, set aside, or altered the certificate. Section 51(2) of the Advocates Act provides that such a certificate is final as to the amount of costs unless set aside or altered. The retainer was not disputed, and the respondent failed to oppose the application or settle the certified sum. Accordingly, the court held that the applicant was entitled to judgment for the certified amount, costs of the application, and interest at 14% from the date of taxation until payment in full.
