Ratio Decidendi

The court found that the applicant's bill of costs had been taxed and a Certificate of Taxation issued. There was no evidence that the certificate had been challenged, set aside, or altered by any court. The respondent, though duly served, failed to oppose the application or attend the hearing. In accordance with section 51(2) of the Advocates Act, the certificate is final as to the amount of costs. The court was satisfied that the applicant was entitled to judgment for the certified sum, together with costs of the application and interest at 14% from the date of taxation until payment in full.
