Ratio Decidendi

The court found that the applicant had rendered legal services to the respondent, obtained a taxed bill of costs, and was issued with a Certificate of Taxation for Kshs. 105,650.00. The respondent did not challenge, set aside, or alter the certificate, nor did it dispute the retainer or settle the amount. Section 51(2) of the Advocates Act provides that such a certificate is final as to the amount of costs unless set aside or altered by the court. In the absence of any challenge or dispute, the court was satisfied that the applicant was entitled to judgment for the certified sum, together with costs of the application and interest at 14% from the date of taxation until payment in full.
